General Terms and Conditions of Use of the site and the services offered.

Use of the site implies full and complete acceptance of the General Terms and Conditions of Use described hereinafter. These General Terms and Conditions of Use may be modified or completed at any time; site users should therefore consult them on a regular basis. This site is accessible to users at all times. Interruption for technical maintenance reasons may, however, be decided by DIGITEX SAS, which will endeavour to inform users of maintenance dates and times in advance. The site is updated on a regular basis. Likewise, the Legal Notice may be modified at any time: it is nonetheless binding on users who are invited to refer to it as often as possible to acknowledge it.

Description of services offered.

The purpose of the site is to provide information about all the activities of the TEMPO, decorative and acoustic comfort brand. DIGITEX SAS endeavours to provide information that is as accurate as possible on the site. Notwithstanding, it cannot be held liable for any omission, inaccuracy or failure to update, whether caused by itself or by third-party partners who provide it with such information. All information mentioned on the site is provided for information purposes only and is subject to change. Furthermore, the information provided on the site is not
exhaustive. It is provided subject to any modification that may have been made since it was placed online.

Contractual limitations on technical data.

The site cannot be held liable for any material damage related to the use of the site. Moreover, site users undertake to access the site using recent, virus-free equipment with an updated latestgeneration browser.

Intellectual property and counterfeiting.

DIGITEX SAS owns the intellectual property rights or holds the rights of use for all elements accessible on the site, in particular texts, images, graphics, logos, icons, sounds and software. Any reproduction, representation, modification, publication or adaptation of all or part of the elements on the site, irrespective of the means or the process used, is prohibited, except in the event of prior written permission from DIGITEX SAS.

Any unauthorized use of the site or of any of the elements contained within will be deemed as constituting an infringement and will be prosecuted pursuant to the provisions of Articles L.335-2 et seq. of the French Intellectual Property Code.


DIGITEX SAS cannot be held liable for any direct or indirect damage caused to a user’s equipment when accessing the site and caused by the use of equipment that does not comply with the specifications mentioned under Point 4, or by the occurrence of a bug or incompatibility.

Personal data management.

In France, personal data is protected namely by French Act No. 78-87 of 6 January 1978, French Act No. 2004- 801 of 6 August 2004, Article L. 226-13 of the French Criminal Code and the European Data Protection Directive of 24 October 1995. In any event, only collects personal data about users for specific
services offered by the site. User provide this personal data knowingly, in particular when they enter it themselves. The site users are, as such, informed of whether or not they are required to provide this data. Pursuant to the provisions of Articles 38 et seq. of French Act No. 78-17 of
6 January 1978 on data protection, users have the right to access, to rectify and to oppose the use of their personal data, by sending a written, signed request, accompanied by a copy of proof of identity bearing the holder’s signature, and specifying the address to which the reply should be sent. No site
user personal data is published, exchanged, transferred, assigned or sold on any medium whatsoever to third parties without the user’s knowledge. Only in the event of a takeover of DIGITEX SAS and its rights would the aforementioned personal data be transmitted to the potential purchaser which, in turn, would be bound by the same data retention and modification obligation vis-à-vis site users. The aforementioned site has been declared with the CNIL, the French data protection authority, under number (currently pending). Databases are protected by the provisions of the French Act of 1st July 1998 transposing Directive 96/9 of 11 March 1996 on the legal protection of databases.

Hyperlinks and cookies.

Browsing the site is likely to cause cookies to be stored on users’ computers. A cookie is a small file that does not allow the user to be identified, but that records information relating to the browsing of a computer on a site. The data obtained is intended to make subsequent browsing on the site easier and is also
used to measure visits. Refusing to store a cookie may mean that specific services become inaccessible. Click the Privacy tab and select Block all cookies. Confirm by clicking Ok. With Firefox: click the Firefox button at the top of the browser window, then select Settings (or Options on some OS). Select the Privacy and Security tab. In the Enhanced Tracking Protection section, select Custom and checkmark Cookies. Use the drop-down menu to choose the type of cookies to block. With Safari: Click the Safari menu button, found at the top-left corner of the web page (wheel-shaped icon). Click Settings. Go to Privacy and Security. Then go to the “Privacy” section. Check the box next to “Block all cookies”. With Chrome: Click the Chrome menu button at the top right corner (symbolized by three horizontal dots or lines). Click Settings. Go to Privacy and Security. Click “Cookies and other site data”. Here you can choose to block cookies.

Applicable law and place of jurisdiction.

Any dispute relating to the use of the site is governed by French law. The Courts of Angers have exclusive jurisdiction.
